Sammanfattning

Children’s right to state their views and the importance of child protection have been emphasized in the latest reform of Swedish family law. In the article, written judgements of the enforcement of court orders about custody, residence and contact from before and after the legislative changes are examined. The aim is to analyse how the argumentation in the judgements has changed since the reform, based on the fact that more cases are dismissed with reference to children’s views and best interests. Results show that the amount of cases where children get to state their view only marginally increased. However, in the cases where children are allowed to state their views, the court seems to take the views into account and let them have a decisive say in the matter more often. Age and gender seem to be integrated factors when the court constructs children as competent enough to refuse enforcement. Earlier, the court argued that a risk, in the long run, is that – if the court order about contact is not enforced – the child might lose (contact with) one parent. In the judgements after the legislative reform, the arguments are more focused on risk of abuse for the child during contact. The latter seem to address the situation here and now, or on a more short-term basis. Results show that the court can give more consideration to children’s participation and protection in a changed perspective on time. It is argued in the article that this increases the possibility to combine discourses of care and the rights of children.
